TERMS & CONDITIONS

A. COVERAGE PERIOD/CONTRACT TERM
1. Sensible Home Warranty, LTD LLC agrees to provide a reputable and qualified contractor to amend or replace a covered item in the occurrence of malfunction or normal damages due to high velocity usage. This contract only covers the exact items that are listed in the plan that you have chosen to enroll in for the allotted time specified in the agreement. The contract term commences after 30 days upon the acceptance of the application and receipt of monetary payment. No agreement will be valid for any reason unlees payment has been received and processed. Coverage may be expedited if proof of prior coverage is obtained and certified with the inclusion that there was no lapse of coverage through another carrier.

B. COVERAGE
1. During the coverage period, Sensible Home Warranty, LTD LLC will arrange for a qualified service contractor to amend or replace any and all items that fall within the contract agreement. The conditions of the agreement for replacing items are the following:

• If they become inoperable due to aggregate, longitudinal usage (i.e. normal "wear and tear")
• If they are located within the main structure of the house/building/or piece of property that the contract has been accepted to cover.
• If they are properly functioning when this contract had been accepted as well as the fact that they must be known to not have any malfunctions or serious detriments when this contract become validated.
• Sensible Home Warranty, LTD LLC is not a maintenance company and is a residential service provider of household systems and appliances. It is the responsibility of the policy holder to service and maintain all systems and appliances as per the manufacturer's specifications. Failure to comply with the above protocol may void the warranty of that system.
• If new items are systematically installed with routine professionalism on the effective date of this contract.

C. WARRANTIES AVAILABLE
1. The Complete System Plan: This plan covers the cook top, stove/oven, built-in microwave, dishwasher, refrigerator, garbage disposal, clothes washer, clothes dryer, plumbing system, heating system, water heater, A/C or cooling unit, electrical, ductwork, plumbing stoppage, garage door opener, and ceiling fans.

2. The Essential System Plan: This plan covers the cook top, stove/oven, built-in microwave, dishwasher, garbage disposal, plumbing system, heating system, water heater, electrical, ductwork, plumbing stoppage, garage door opener, and ceiling fans.

3. The General System Plan: This plan covers the plumbing system, heating system, water heater, A/C or cooling unit, electrical, and ductwork.

4. The Basic Appliance Plan: This plan covers the cook top, stove/oven, built-in microwave, dishwasher, refrigerator, garbage disposal, clothes washer, and clothes dryer.

5. Optional Coverage may be purchased for the following products: pool/spa, well pump, sump pump, central vacuum, limited roof leak, septic system, ice maker, water/dispenser second refrigerator, stand alone freezer, and septic tank pumping.

D. CUSTOMER SERVICE
1. In the event that a covered item has malfunctioned or is within the limits of coverage specifically stated by the contract, Sensible Home Warranty, LTD LLC must be contacted within 24 hours and receive notification.

2. Sensible Home Warranty, LTD LLC maintains the right to select the service contractor, which may be a company affiliated with Sensible Home Warranty. Sensible Home Warranty, LTD LLC is not responsible for and will not reimburse any monies to persons who have sought and received repairs, reinstallations, or services provided by others unless a confirmation number has been provided.

3. When a request for service is made, Sensible Home Warranty, LTD LLC will contact a reputable contractor within 24-48 hours or approximately 2 business days. In case of emergency a service contractor will be contacted immediately. A service fee applies for each service call made (per issue) , or the actual cost depending upon which deductible fee is the lesser amount.

E. COVERAGE- (INCLUDES ALL ITEMS IN PLAN SPECIFIC POLICIES)
1. Range/Oven/Cook top
a. COVERED: all necessary components and parts in a gas or electric oven/stove cook top with the exception of:
b. NOT COVERED: oven racks, glass clocks/timers, lights, trays, shelves, glass doors, self-cleaning features, meat probes, rotisseries, baskets, exterior trim, and oven tool accessories.

2. Built-In Microwave
a. COVERED: all necessary components and parts with the exception of:
b. NOT COVERED: glass handles, doors, hinges, racks, portable/countertop units, lights, and microwavable additional accessories.

3. Dishwasher
a. COVERED: all necessary components and parts with the exception of:
b. NOT COVERED: rollers, baskets and racks, doors, cleaning, and associated gadgets.

4. Refrigerator
a. COVERED: One standard kitchen refrigerator, complete with all the necessary components and parts with the exception of:
b. NOT COVERED: doors, hinges, cosmetic work, racks/shelves, drawers, lights, free-standing ice makers, ice-making and/or water dispensing units, digitally operated control panels, leaks of any kind, wine coolers, mini refrigerators or beverage units, Freon-lined restrictions, knobs, gaskets, and freely dispensing hot water systems. In addition, Sensible Home Warranty, LTD LLC is not responsible for the loss of food, beverage or other stored items due to failure of the unit.

5. Garbage Disposal
a. COVERED: all necessary components and parts and inclusively the entire piece of equipment.
b. NOT COVERED: Problems and/ or jams caused by bones and foreign objects other than food

6. Clothes Washer
a. COVERED: all necessary components and parts with the exception of:
b. NOT COVERED: plastic mini tubs, knobs and dials, soap dispensers, filter screens, doors, noise, and irreparable damage to clothing.

7. Clothes Dryer
a. COVERED: all necessary components and parts with the exception of:
b. NOT COVERED: doors, venting, lint screens, knobs and dials, noise, and irreparable damage to clothing.

8. Plumbing System
a. COVERED: toilet wax ring seals, toilet tanks, bowls, and related functioning mechanisms, any gas, water waste, drain, or vent lines, shower valves, bathtub valves, and other primary stoppage components, risers, and gate valves, built-in bathtub unit accompanied by motor and pump assembly.
b. NOT COVERED: the failure of water distribution due to gas, drain, waste, or freezing vent lines, Polybutylene or quest piping, breakages or leaks in water lines caused by rust, corrosion, or calcium deposits, slab leaks, clean outs, drum traps, faucets and fixtures, bathtubs and showers, roman tubs, galvanized drain lines, bidets, basket strainers, sinks, grouting septic tanks, water softeners, hot water dispensing units, pressure regulators, shower enclosures/base pans, sewage eject ejector pumps, holding/storage tanks, trip lever waste and surplus, saunas or steam rooms, bath jets, hose bibs, and control panels. Sensible Home Warranty, LTD LLC is not responsible for damage that exceeds $500.00 per contract term for access, diagnostics, repair, and/or replacement. Sensible Home Warranty, LTD LLC will not pay monies for the process of moving and replacing any built-in appliances or any obstructions impeding access to walls, ceilings, or floors in order to assess and/or repair the malfunctioning mechanism. The authorized service contractor that we have provided will return the area to rough finish condition, subject to the $500 limit indicated.

9. Heating System
a. COVERED: all necessary components and parts for the proper functioning of the system with the exception of:
b. NOT COVERED: all components and parts relating to water source heat pumps (geothermal), radiators, valves, radiant heating, dampers, fuel storage tanks, solar heating systems, portable units, baseboard casings, most kinds of filters, fireplaces and key valves, clocks/timers, annexed zoning systems, heat lamps, flues and vents, humidifiers, backflow preventers, registers, cable heat, chimneys, mismatched systems, calcium deposits, wood stoves, pellet stoves, and maintenance. Sensible Home Warranty, LTD LLC will not cover items that exceed a five-ton capacity. Sensible Home Warranty, LTD LLC will not replace heating system due to cracked heat exchanger on units over 10 years of age.Sensible Home Warranty, LTD LLC will not endorse payment that exceeds $1500 per covered item per contract term for access, diagnostics, repair, and/or replacement.

10. Water Heater
a. COVERED: all necessary components and parts with the exception of:
b. NOT COVERED: pressure-reducing valve, solar water heaters, fuel storage tank and/or energy conservation units, vents and flues, access-insulation blankets, sediment buildup and calcification, and noise, instant hot water dispenser. Sensible Home Warranty, LTD LLC will not be responsible for replacement of water heaters over 10 years of age.

11. A/C or Cooling Unit
a. COVERED: thermostats, compressors, condenser fan motors, blower fan motors, evaporators, cooler units, air handlers, ducted electric central air conditioning and all necessary components and parts to the proper functioning of the system with the exception of:
b. NOT COVERED: gas air conditioning systems, condenser casings, additional service valves, filters, line dryers, line sets, water cooled condensing units, condensate pumps, registers and grills, primary/secondary drain pans, window units, leveling equipment, evaporative cooler pads, electronic air cleaners, improperly sized air condition units or mismatched systems, annexation of additional latter components, flues, vents, roof jacks/stands, water towers, humidifiers, non-ducted wall units, refrigerant conversions, costs related to freon, freon recapturement, drain line stoppages, water leaks, chillers and related components, maintenance and noise. Sensible Home Warranty, LTD LLC will not cover items that exceed a five-ton capacity. Sensible Home Warranty, LTD LLC is not responsible for covering more than two operating systems unless thus indicated by initial contract signing at time of enrollment.

12. Electrical
a. COVERED: all necessary components and parts with the exception of:
b. NOT COVERED: power failure/surge wiring of components, auxiliary or sub panels, wire tracing, re-running of new wire for broken lines, central vacuum systems, doorbells, alarms, intercoms, fixtures, attic exhaust fans, and garage door openers. Sensible Home Warranty, LTD LLC is not responsible for damage that exceeds $500 per contract term for access, diagnostics, repair, and/or replacement.

13. Ductwork
a. COVERED: ducts from heating and/or cooling units to the point of attachment at flex ductwork, grills, or registers.
b. NOT COVERED: insulation, asbestos, dampers, improperly sized ductwork, insulated ductwork, registers and grills. Sensible Home Warranty, LTD LLC is not responsible for damage that exceeds $500 per contract term for access, diagnostics, repair, and/or replacement. Sensible Home Warranty, LTD LLC will not pay monies for the process of moving and replacing any built-in appliances or any obstructions impeding access to walls, ceilings, or floors in order to assess and/or repair the malfunctioning mechanism. The authorized service contractor that we have provided will return the area to rough finish condition, subject to the $500 limit indicated.

14. Plumbing Stoppage
a. COVERED: cleaning of stoppages in drain, vent and sewer lines within 100 feet from access point; mainline stoppages are cleared when there is a readily accessible ground level clean out.
b. NOT COVERED: stoppages caused by collapsed, broken, or ill damaged vent, drain, and sewer lines outside the limit of 100 feet from given access point or preceding the confines of the main foundation, stoppages due to roots or foreign acquired objects and if the lines have been broken or infiltrated by such, costs to provide for a ground level clean out which is required, and septic tanks.

15. Garage Door Opener
a. COVERED: motor, switches, wiring, track assembly, and receiver units.
b. NOT COVERED: springs, tracks, travelers, remote transmitters, hinges, doors, sensors, and cables.

16. Ceiling Fans
a. COVERED: all necessary operating components and parts.
b. NOT COVERED: Fan blades or lights.

F. OPTIONAL COVERAGE- (UPON ADDITIONAL PAYMENT TO CONTRACT FEES)
1. **NOTE- Optional Coverage may be purchased in addition for more adequate coverage up to a 30-day period subsequent to the commencement of the original contract. These optional features only cover the exact items that are listed in the plan that you have chosen to enroll in for the allotted time specified in the agreement.

i. Pool/Spa
a. COVERED: pool and built-in spa equipment that utilize shared commodities. If they do not share usage then either one or the other may be selected for coverage unless you wish to incur an additional fee for the complete coverage of both luxuries that are above ground operating systems. Heater, pump, filter, gaskets, timer, blower, limited-back flush,, filter timer, check valves, motor and pump sweep, above ground piping, wiring, and plumbing, as well as relays/switches are covered.
b. NOT COVERED: display lights, liners, solar equipment, jets, waterfalls and subsequent pumping/operational systems, fill line and valve, decorative fountains, control panels and electronic boards, structural defects, pop up heads, turbo valves, storage tanks, disposable filtration systems, portable/ above ground spas, cracked/ rusted film casings, salt-water systems, chlorinators and ionizers, heat pump, and detachable cleaning equipment and accessories. Sensible Home Warranty, LTD LLC is not responsible for damage that exceeds $500 per contract term for access, diagnostics, repair, and/or replacement.

ii. Well Pump
a. COVERED: all necessary components and parts that are utilized as the main water source to the home with the exception of:
b. NOT COVERED: locating the pump, check valve, drop pipe, holding/storage tanks, re-drilling of wells, booster pumps, well pump and related components for geothermal water source heat pumps, pump retrieval, well casings, pressure tanks, pressure switches/gauges, and electrical lines/piping leading to and/or connecting a well pump.

iii. Sump Pump
a. COVERED: sump pump for ground water specific within the main confines of the home or extended garage.
b. NOT COVERED: sewer ejector pumps, check valves, piping modifications for new installations, portable pumps, and back flow preventer's.

iv. Central Vacuum
a. COVERED: all necessary components and parts for the proper functioning of the mechanism.
b. NOT COVERED: pipes, hoses, clogged pipes, and other related accessories.

v. Limited Roof Leak
a. COVERED: shingles, repair of shake, and roof leaks over the occupied living area.
b. NOT COVERED: cracked/missing material, foam roofs, tar, gravel, and metal roofs, flat or built-up roofs, structural leaks caused by gutters or downspouts, flashing, decks, skylights, solar equipment, patios, porches, patio covers, roof jacks, chimneys, antennae, or partial roof replacement as maintenance. If roof must be partially or completely replaced to make a suitable repair this policy is void and does no longer apply. Sensible Home Warranty, LTD LLC is only responsible for covering roofs for single-family dwelling residences.

vi. Septic System
a. COVERED: sewage ejector pump, jet pump, aerobic pump, septic tank and line from residence.
b. NOT COVERED: leach lines, lateral lines, pumping, clean out, field lines, field and leach beds, insufficient space and/or capacity, cost of diagnosis, repair and/or installation with replacement of the system which is inclusive for pumps, Sensible Home Warranty, LTD LLC limits the total cost of the covered septic system to an amount of $500.

vii. Second Refrigerator
a. COVERED: all necessary components and parts for the proper functioning of the mechanism with the exception of:
b. NOT COVERED: : leaks of any kind, door gaskets and seals, shelves/drawers and racks, hinges, doors, lights, ice making/dispensing and beverage dispensing equipment, digital control panels, food spoilage, freezer that is not an integrated part of a refrigerator, line restrictions, interior thermal shells, wine coolers and mini refrigerators.

viii. Stand Alone Freezer
a. COVERED: all necessary components and parts for the proper functioning of the mechanism with the exception of:
b. NOT COVERED: leaks of any kind, door gaskets and seals, shelves/drawers and racks, hinges, doors, lights, ice making/dispensing and beverage dispensing equipment, digital control panels, food spoilage, freezer that is not an integrated part of a refrigerator, line restrictions, interior thermal shells, wine coolers and mini refrigerators.

ix. Septic Tank Pumping
a. COVERED: drain stoppages due to septic tank backups
b. NOT COVERED: cost of finding and/or gaining an accessible region to treat/modify the septic tank, septic tank pumps, leach lines, chemical treatments and Cesspool. Sensible Home Warranty, LTD LLClimits the total cost of the covered septic tank pumping to an amount of $200. Sensible Home Warranty, LTD LLCwill only allow the procedure of pumping one septic tank, one time only.

G. CONDITIONS OF CANCELLATION "MONEY BACK GUARANTEE"
1. To receive a full refund, this contract may become null and void by the contract holder within 30 days from the order date of the contract unlesss policy was actived immediately.

2. Following 30 days refunds are issued on a prorated basis.

3. Cancellation requests must be formally written and received by Sensible Home Warranty. If cancellation is requested via email, the policy holder is required to obtain a confirmation reply. In the event of a cancellation request submission, the provider of funds will be entitled to nothing less than the paid prorated amount, or a full refund and monetary compensation in the exact form that the contract fees have been paid. The provider of funds will not incur any administrative fees or penalties. If the contract holder fails to request a cancellation of a contract within the valid dates then cancellation of such options is noted and determined by Sensible Home Warranty, LTD LLC administrators.

4. If a claim has been approved by Sensible Home Warranty, the policy may not be cancelled per the same contract year. However, the policy holder may receive a prorated refund for the remaining years on a multi-year term.

5. If a claim had been denied as per the terms of this contract the policy may not be cancelled solely for that reason. Should the policyholder wish to cancel based on the fact a claim has been legitimately denied, a prorated refund may be issued but will be subjected to a penalty equal twenty-five percent of the paid premium.

6. This contract is not able to be voided by Sensible Home Warranty, LTD LLC unless:
a. There is a failure to pay contract fees
b. Both parties (i.e. the contract holder and Sensible Home Warranty) deem it mutually beneficial to terminate the agreement
c. The contract holder has misrepresented him/herself in the issuance of the contract

7. Failure to cancel the contract within the allotted time period and dates, if agreed upon by Sensible Home Warranty, LTD LLC that the contract may be considered null and void, the original contract holder receive a prorated refund and will only incur charges for the time in which the services of Sensible Home Warranty, LTD LLCwere utilized.

8. An appeal of any kind is acceptable and encouraged if the policy holder feels there has been wrongdoing on the part Sensible Home warranty. Any appeal must be formally submitted in writing and sent to the corporate address listed on this policy.

9. Cancellation of the contract results in Sensible Home Warranty, LTD LLC having no responsibility or further affiliation with previous parties involved.

H. CONTRACT RENEWALS/CHANGE OF INFORMATION
1. If and when the covered property changes ownership during the course of a valid contract, Sensible Home Warranty, LTD LLC must be contacted immediately via 1-866-959-2212 to extend coverage to the new owner as long as he/she does not misrepresent him/herself or give fraudulent information in terms of the contract disclosure agreement.

2. Contract holders may transfer this contract at any given time during the period by which the dates are valid according to the contractual term.

3. Contract holders will not be automatically be renewed for annual contracts unless there is formal writing at the request of 30 days prior to the expiration of the contract.

4. Payment will be seen as tangible evidence of informed consent to the terms and conditions of the contract.

I. INVESTMENT PROPERTY/MULTIPLE UNITS
1. If Sensible Home Warranty, LTD LLC is chosen to cover a duplex, triplex, or quadruplex dwelling, then every subsequent unit within such a residence must also be protected with valid contracts agreed upon by Sensible Home Warranty, LTD LLC standards.

2. Under the circumstances that a contract holder fails to meet this condition, then Sensible Home Warranty, LTD LLC is not responsible for shared systems within the residence.

3. In the event that the dwelling unit exceeds a quadruplex, then each individual contract holder is covered for what is specifically determined in each sole contract. Common systems and appliances will otherwise be excluded.

J. BILLING PROCEDURES
All funds and monetary exchanges paid to Sensible Home Warranty, LTD LLC will be seen as informed consent to the terms and conditions of the contract and compliance with the mentioned requisites and regulations.
Payment is for maintenance, repair, partial or full replacement for manufactured products that Sensible Home Warranty, LTD LLC covers according to the specific contract in which the contract holder has enrolled. Sensible Home Warranty, LTD LLC is not an insurance company and does not provide warranty, extended warranty, implied warranty, or residential service.

K. ZONING CODE REQUIREMENTS/VIOLATIONS
1. Sensible Home Warranty, LTD LLC is not responsible for any modifications to install an upgrade, work, or costs required to comply with federal, state, or local laws, regulations, ordinances, or the need to meet current building or zoning code requirements, or for the correction of certain code violations.

2. Sensible Home Warranty, LTD LLC is not responsible for the failure of a federal, state, or local department issuance of a permit nor is responsible for the monetary penalty of such permit.

3. Sensible Home Warranty, LTD LLC will not bequest contractors to perform services nor pay costs involving hazardous, toxic materials including but not limited to: asbestos, mold, lead paint, sanitation of sewage spills and various other teratogenic agents.

4. Sensible Home Warranty, LTD LLC will also not pay costs to related recapturement/disposal of refrigerants, contaminants, hazardous, or toxic agents and materials. In the event that costs related to Freon recapture are part of your covered plan then Sensible Home Warranty, LTD LLCwill be responsible for covering the determined costs.

L. LIABILITY
1. Sensible Home Warranty, LTD LLC is not responsible for providing or closing the accessed point of origin or area to covered items or the cost of an additional service fee encountered by the service contractor to dispose or discard an old appliance, system, or damaged component including but not limited to the following: condensing units, capacitors, freezers, refrigerators, evaporator coils, water heaters, compressors, and any potential dangerous or threatening waste materials.

2. Sensible Home Warranty, LTD LLC is not responsible for the repair, restoration, or replacement of commodities due to cosmetic defects upon the performance of services. Sensible Home Warranty, LTD LLC can also not be held liable for consequential or secondary damages incurred during the performance of services, delay in obtaining required equipment and related parts as well as labor difficulties.

3. Sensible Home Warranty, LTD LLC has the right to determine whether a covered appliance or system will be replaced or repaired. Sensible Home Warranty, LTD LLC does not cover electronic, computerized, or energy sufficient management systems, devices, and/or appliances.

4. Sensible Home Warranty, LTD LLC will maintain the level of efficiency when replacing an appliance or system and attempt to take into account dimensions, brand, and color, but cannot guarantee a custom fit.

5. Sensible Home Warranty, LTD LLC is not held responsible for the repair of covered items that need to be covered due to but not limited to the following: chemical and sedimentary build-up, rust, corrosion, abuse, failure to maintain, failure to clean, freezing, fire, storms, accidents, pet damage, water damage, electrical surge, lightening, mud, earthquakes, plate tectonics, water pressure, atmospheric pressure, or an unsettling home.

6. Sensible Home Warranty, LTD LLC is not responsible if a private contractor is used and does not repair, replace, and/or choose a compatible product that cohesively bonds with the malfunctioning system.

7. Sensible Home Warranty, LTD LLC is not responsible for the cost of updating, modifying, or constructing new systems in order to comply with state, federal, or local laws and/or building, zone codes, and fixing a violation.

8. Sensible Home Warranty, LTD LLC does not provide routine maintenance. The corporation has determined that it is the customer's personable responsibility to care for his/her home and the items listed in the contract in order for them to receive coverage. Sensible Home Warranty, LTD LLC has the right to receive receipts of maintenance upon request from the contract holder.

9. Sensible Home Warranty, LTD LLC has the right to use discretion on which items are suitable to be covered upon the contract holder's request depending upon how they have abided by the rules and regulations of the agreement.

10. Sensible Home Warranty, LTD LLC is not responsible for the reparations that exceed $1500 for any single unit, operating system, or related appliance.

11. Sensible Home Warranty, LTD LLC is not responsible for covering the cost of diagnosis, repair, or replacement of an item that has been corroded, rotten, fungus-ridden, or biologically harmful that has caused the agent in question to malfunction.

12. Sensible Home Warranty, LTD LLC is not responsible for the replacement or repair of an item that has been termed "commercial." Sensible Home Warranty, LTD LLC is furthermore not responsible for the repair or replacement of an item that has been recalled by the manufacturer, regardless of the reason. Sensible Home Warranty, LTD LLC is also not responsible for the repair or replacement of a commodity that has been determined to be "defective" by the Consumer Product Safety Commission or manufacturers that have issued warnings regarding specific products.

13. Sensible Home Warranty, LTD LLC has the right to provide cash-back in lieu of repair or replacement in the amount of Sensible Home Warranty's actual cost (which may be determined as a lesser amount than subjected retail). If parts are no longer available, Sensible Home Warranty, LTD LLC also has the right to offer a cash buyout in the amount of the assessed average costs between labor, parts, and covered repairs.

M. REPLACEMENT/MAINTENANCE REQUIREMENTS
1. In the event one of the major systems (ie. Air conditioner, heater or water heater) is beyond normal repair and requires replacement of parts or complete replacement, Maintenance records are required. In the event no maintenance can be had (ie. New home purchase) a copy of the home inspection must be furnished to Sensible Home Warranty. Major systems will only be replaced with the proper documentation.

2. Sensible Home Warranty, LTD LLC is not a maintenance company. It is the responsibility of the policy holder to properly service and maintain the covered appliances and systems. Failure to comply with proper maintenance protocol as per the manufacturer's specifications will be considered neglect and the warranty on that system or appliance may become void.

N. SUBMISSION TO ARBITRATION
1. In the event that a controversy or claim arises that is related to or out of this subjective agreement, it must be submitted to the American Arbitration Association in the state of Nevada, Washoe Country regardless of contract holder residency.

2. All claims will be resolved and/or settled at the location of AAA regardless of whether or not they are considered valid under local, state, federal law, or subjective to limitations of liability.
